Registration
    Information:
    • MEMBERSHIP:
      WIPO, TRIPS, Paris Convention and Madrid Protocol
    • CLASSIFICATION:
      10th edition — single class application
    • CLAIMING PRIORITY:
      Possible
    • SEARCH/TIME FRAME:
      Possible for word marks and device marks / 7 – 10 working days
    • EXAMINATION:
      On formal, absolute, and relative grounds
    • EXTENSION OF TIME:
      Not possible for filing oppositions. Possible for filing counter oppositions and responding to office actions
    • VALIDITY:
      10 years as from the filing date
    • RENEWAL:
      For unlimited period of 10 years each
    • GRACE PERIOD:
      6 months from the protection’s expiry date.
    • USE:
      Vulnerable to cancellation by any interested party if there has been no effective use of the mark within the 5 years preceding the date of filing for cancellation.
    Requirements:
    1. A Power of Attorney duly legalized up to the Bahrain Consulate;
    2. A certified copy of the Certificate of Incorporation of the applicant company or an Extract from the Commercial Register duly legalized up to Bahrain Consulate; and
    3. Fifteen prints of the mark.
      • A general POA may be used for subsequent filing.
      • All the documents must be submitted at the time of filing. However, a faxed copy can be submitted together with the application form in order to secure filing number and date. The original legalized document can be filed within 90 days from the date of filing the application.
    Time frame:
    1. Filing up to Examination: 12-14 months
    2. Examination up to Publication: 3-5 months
    3. Opposition Period: 60 days from the publication date
    4. End of opposition period up to issuance of registration certificate: 2-4 weeks
    5. Total estimated time frame: 18-22 months
      The above time frame is for a normal/smooth processing of a trademark application, in case of no objections by the trademark examiner or no oppositions from a third party.
Renewal
    Filing Requirements:
    1. Power of Attorney with Apostille certification.
Change of Name or Address
    Filing Requirements:
    1. Power of Attorney with Apostille certification; and
    2. Copy of certificate of change of name/address or a letter from the owner of the trademark to this effect addressed to the Registrar
      • Must be recorded within 3 months from effective date otherwise a surcharge is levied.
      • May be recorded for registrations only.
Assignment
    Filing Requirements:
    1. Power of Attorney with Apostille certification; and
    2. Deed of assignment, signed by both parties, with Apostille certification.
      • Trademarks may be assigned with or without the goodwill of the business concerned.
      • May be recorded for registrations only.
Merger
    Filing Requirements:
    1. Power of Attorney with Apostille certification; and
    2. Certificate of merger, with Apostille certification.
      • May be recorded for registrations only.
License
    Filing Requirements:
    1. Power of Attorney with Apostille certification; and
    2. License agreement, with Apostille certification.
      • License recordal is not compulsory but advisable in order to be effective against third parties.

PATENT
Information

    1. A Power of Attorney duly legalized up to the Bahrain Consulate;
    2. A certified copy of the Certificate of Incorporation of the applicant company or an Extract from the Commercial Register duly legalized up to Bahrain Consulate;
    3. A deed of assignment signed by the inventor and the applicant duly legalized up to Bahrain Consulate, if the applicant is not the inventor;
    4. Two copies of the specifications, claims, abstract and drawings; and
    5. A certified copy of the priority document, if priority is claimed.
Change of Name or Address
    Filing Requirements:
    1. Power of Attorney with Apostille certification;
    2. Extract from the Commercial Register, showing old and new names/addresses, with Apostille certification; and
    3. If new name, then new POA, with Apostille certification.
      • Documents must be translated into Arabic upon submission.
License
    Filing Requirements:
    1. POA with Apostille certification.
      • A patent has to be worked within 3 years from grant date. The patent may be subject to compulsory licensing according to the provisions in the law.
DESIGN

      As to form, novelty and industrial applicability
    • ANNUITIES:
      A maintenance fee is due annually on the date of first publication. There is a 6-month grace period for late payment with a surcharge

    1. A Power of Attorney duly legalized up to the Bahrain Consulate;
    2. A certified copy of the Certificate of Incorporation of the applicant company or an Extract from the Commercial Register duly legalized up to Bahrain Consulate;
    3. Three copies of the description of the model or design together with relevant drawings, if any; and
    4. A certified copy of the priority document, if priority is claimed.
      • All documents must be submitted at the time of filing.
Renewal
    Filing Requirements:
    • None. Allowed for one term of 5 years.

    • WORKS PROTECTED:
      Books, pamphlets and other writings, lectures, sermons, theatrical works, musical works, musical compositions, cinematographic works, works of drawing, painting, architecture, sculpture, engraving, photographic works, works of applied art, illustrations, maps, plans, sketches and three-dimensional works, as well as computer programs. The law also provides protection related rights including works of performers, producers of sound recordings and broadcasting organizations.
    Requirements:
    1. A Power of Attorney duly legalized up to the Bahrain Consulate;
    2. An Assignment Deed duly legalized up to Bahrain Consulate, if the applicant is not the author;
    3. A certified copy of the Certificate of Incorporation of the applicant company or an Extract from the Commercial Register or a certified copy of home or any foreign registration, any of which, duly legalized up to Bahrain Consulate; and
    4. Two copies of the work.
DOMAIN NAME
Requirements
    Requirements:
    1. A written request in the letterhead of the applicant requesting the registration of the domain name;
    2. A Power of Attorney duly legalized up to the Bahrain Consulate; and
    3. An Extract from the entry of the applicant in the Commercial Register or any equivalent document, duly legalized up to Bahrain Consulate.
