1. Will a patent granted by the GCC Patent Office located in Saudi Arabia protect the patent in all member countries including Qatar?

YES.

2. Are scientific theories, mathematical methods, computer programs, exercise of pure intellectual activities, or practice of a specific game patentable?

NO.

3. If two persons or more have collectively worked on an invention, who will obtain the right of ownership?

Both shall have equal right for patent unless otherwise agreed.

4. Is Qatar a member of Gulf Cooperation Council, Patent Cooperation Treaty and Paris Convention?

YES.

5. Can convention priority be claimed according to Paris Convention?

YES, within 12 months from the first filing date.

6. Can a patent equivalent search be conducted?

Not available this time.

7. Can the application be filed without the legalized Power of Attorney?

YES, the legalized POA can be lodged at a later stage.

8. Can I file the application with the complete specifications of the invention including abstract and claims in English?

YES, the Arabic translation may be submitted at a later stage.

9. What is the allowed time to submit the Deed of Assignment from the date of signing the agreement?

There is no time restriction.

10. When annuities are to be paid?

Due annually on the anniversary of the international filing date and payable prior to grant.

11. Is late payment of the annuity fees allowed?

YES, there is 6 - month grace period for late payment with a surcharge.

12. What is the period of protection of a patent?

20 years from the filing date.

13. When can I expect my application to be published?

Applications will be published upon grant in the official gazette.

14. Is there any provision for filing opposition?

YES, oppositions may be filed within 60 days from announcement.

15. Does the Patent Law provide for licenses or registered users?

YES.

16. What is a Contracting License?

The license issued to others to exploit the patent subject to the consent of its owner.

17. What is Mandatory License?

The license issued by ministerial decree without the consent of the owner in the cases identified by the law.

18. In what language should the specification and claims of the patent be filed?

Both in English and Arabic.
